Thank you for your interest in joining Heritage Family Farms' herd share program! Please complete this application to get started. After your agreement is signed, you'll receive access to purchase your herd share.

1. Purpose

This Agreement establishes a herd share ownership arrangement under Oregon law. The Member is purchasing an ownership interest in a dairy herd maintained by the Farm. In exchange, the Member is entitled to receive a proportional share of raw milk and/or dairy products produced by the herd.

The Member acknowledges this is not a retail purchase of milk, but an ownership relationship.

2. Purchase of Herd Share

2.1 Ownership Interest

2.3 Boarding & Care Fee

Feed
Veterinary care
Breeding

Farm overhead

3. Distribution of Milk

3.1 The Member is entitled to receive approximately ___ gallon(s) per share per week, subject to seasonal production variations.

3.2 Milk will be delivered to the selected drop site or picked up at the farm.

3.3 The Farm does not guarantee specific production levels due to natural herd conditions.

4. Risk Acknowledgment & Assumption

The Member understands and agrees:

Raw milk is not pasteurized.
Raw milk may contain naturally occurring bacteria.
The Member voluntarily assumes all risks associated with consuming raw milk and raw dairy products.
The Member understands that the State of Oregon regulates herd share agreements differently than retail dairy sales.

The Member releases and holds harmless the Farm, its owners, employees, and agents from liability related to consumption of raw dairy products except in cases of gross negligence or intentional misconduct.

5. Member Responsibilities

The Member agrees:

To keep contact information current.
To promptly retrieve milk from drop sites.
To store milk safely and refrigerate properly.
Not to resell or redistribute milk.
To comply with all Oregon herd share regulations.

6. Term & Termination

6.1 This Agreement begins on the Effective Date and continues month-to-month unless otherwise specified.

6.2 Either party may terminate with ___ days written notice.

6.3 Upon termination:

Boarding fees must be paid through the final date.
Herd share ownership may be:
- Sold back to the Farm at original purchase price, OR
- Transferred to another approved Member.

7. Non-Refund Policy

Boarding and care fees are non-refundable once milk production has been allocated.

8. Farm Practices Disclosure

The Member acknowledges receipt of information regarding:

Feeding practices
Animal health standards
Milking procedures
Sanitation protocols
Testing practices

9. Force Majeure

The Farm is not liable for interruption of milk production due to events beyond its control including but not limited to:

Disease outbreak
Natural disaster
Government action
Equipment failure

10. Governing Law

This Agreement shall be governed by the laws of the State of Oregon.

11. Digital Signature & Consent

By electronically signing below, the Member acknowledges:

They have read and understand this Agreement.
They voluntarily enter into a herd share ownership arrangement.
They consent to digital signature under the Oregon Uniform Electronic Transactions Act.
